General conditions of sale for products sold on MindGeek
Intellectual property
The creative services, including media files, images, videos and WordPress code, remain the property of MindGeek even after full payment of the price. MindGeek reserves the right to reuse these elements for other projects or purposes.
Responsibilities
The customer is fully responsible for any changes made to the website after delivery. In the event of technical problems resulting from these changes, MindGeek reserves the right to charge additional troubleshooting fees. However, MindGeek is committed to providing technical support to the extent of its capabilities to resolve any issues encountered.
GDPR and privacy
MindGeek undertakes to respect the confidentiality of the information provided by the customer as part of their order, in accordance with the General Data Protection Regulation (GDPR). The personal data collected is treated confidentially and securely, and is only used for order fulfillment and customer support. They will under no circumstances be transmitted to third parties without the explicit consent of the customer. The customer has the right to access, rectify and delete his personal data, which he can exercise by contacting MindGeek.
Right to retract
In accordance with article L.221-28 of the Consumer Code, the customer does not benefit from a right of withdrawal for the purchase of a personalized website, created specially according to his specifications. However, if the customer wishes to cancel their order before the site creation or development process begins, they may do so by contacting MindGeek. In this case, cancellation fees may be applied depending on the work already done by MindGeek.
Disputes
In the event of a dispute, the parties undertake to seek an amicable solution before taking any legal action. In the absence of an amicable agreement, any dispute relating to the interpretation or execution of these General Terms and Conditions will be submitted to the competent courts in accordance with the rules of common law.
